Keys For Recognition Initiative Terms and Conditions

The Operator

1. The operator of the Keys For recognition initiative is Keys For Limited (company number 12751336) whose registered office is Travel Chapter House, Gammaton Road, Bideford, England, EX39 4DF (“Keys For”).
2. Keys For is a company limited by guarantee.

The Recognition Initiative

3. Keys For have established a recognition initiative for people to nominate others to receive a stay at a holiday property in Great Britain (the “Reward”) in recognition of going that extra mile. For the avoidance of doubt you cannot nominate yourself for a Reward.
4. The Reward will be facilitated by one of Keys For’s suppliers (the “Suppliers”)
5. The Reward will be subject to the Supplier’s specific terms and conditions for that particular property. The Reward includes only the accommodation itself. Insurance, travel, food and other miscellaneous costs are not included in any Reward and will be the sole responsibility of the Awarded Nominee. The accommodation for all Rewards will be generously donated by the owners of the holiday property. Naturally, guests will be expected to take good care of the holiday property and will be expected to cover any costs in the unlikely event they cause damage at the holiday property.

How to Nominate

6. It is free to nominate a person for a Reward, no purchase is necessary and there is no charge to nominate anyone for a Reward.
7. Any person can nominate and be nominated provided they (i) live in the Great Britain (which excludes Northern Ireland) (ii) are aged 18 years or over and (iii) satisfy Key’s For eligibility criteria.
8. Employees of Keys For, or its holding or subsidiary companies, or employees of any Supplier, or its holding or subsidiary companies, as well their families, will not be eligible to receive any Rewards.
9. By making a nomination you confirm that you are eligible to do so and the person you are nominating has agreed to be nominated and is eligible to receive the Reward. Keys For may require you (and the person you have nominated) to provide proof that they are eligible for the Reward.
10. By making a nomination you accept the Reward will ultimately be selected by the Suppliers, and could be at any property marketed by a Supplier and for any dates. There is more information about the award process below.
11. The eligibility criteria for the person you are nominating will be clearly set out on the application form. Keys For would like to reward as many different people and good causes as possible and therefore Keys For may change the eligibility criteria from time to time. However, provided your nomination meets the eligibility criteria at the time you make a nomination your nominee will be considered for a Reward.
12. To nominate someone, submit the online entry form here and provide the details requested.
13. Nominations through agents or third parties, including nominations which are automatically generated by computer; completed by third parties or in bulk; illegible, have been altered, reconstructed, forged or tampered with; photocopies and not originals; or incomplete will not be accepted.
14. Only one nomination per email address is permitted in each three month award period (see paragraph 20) and the first nomination submitted by each email address in each three month award period will be accepted as a nomination for the recognition initiative in that three month period in accordance with these terms. Any subsequent entries in that period will be disallowed. Similarly, each nominee may only be nominated once for the recognition initiative.
15. Keys For reserve the right to disqualify you and the person you nominate if your conduct is contrary to the spirit of the recognition initiative.
16. Only nominations that have been completed correctly and in full will be considered for a Reward. Keys For will not accept any responsibility for late, lost, delayed or damaged entries and cannot be held responsible for any inability to submit entries as a result of a computer service, systems and/or server failure, error, interruption, defect or delay or any other technical malfunction.
17. You will not be able to make a nomination without accepting these Terms and Conditions.
18. Keys For do not accept liability for network, computer, hardware, software failures or technical failures of any kind, which may restrict or delay you submitting an entry.

The Award Process

19. Selection of successful nominees will be made by a selection panel that will include at least one person who is independent of Keys For and any Supplier (the “Selection Panel”).
20. The Selection Panel will consider nominations periodically throughout the year at regular intervals (the “Award Meetings”).
21. At each Award Meeting the Selection Panel will consider the nominations made in the preceding period and will select a number of nominations that they decide (acting reasonably) should be offered Rewards (the “Successful Nominations”).
22. The Selection Panel will have discretion over the number of Successful Nominations that are chosen, save that Keys For reserves the right to set reasonable parameters to ensure Successful Nominations can be accommodated, and will not be required to select Successful Nominations for each and every Reward that is available from the Suppliers at that time.
23. Keys For will then contact the people that made the Successful Nominations within 10 Business Days to ask their nominee (the “Awarded Nominee”) to contact Keys For to claim a Reward.
24. Keys For or their representatives will then try (using reasonable efforts) to match the Awarded Nominee’s preferences to the Rewards that are available at that time. However, no guarantee can be made to meet those preferences. The Reward could be at any property of any accommodation size and/or any location.
25. An Awarded Nominee is not required to accept a Reward, either before or after a specific property is proposed to them, and if an Awarded Nominee chooses not to accept a Reward that is proposed to them (during the dates proposed to them), for any reason whatsoever, neither Keys For nor the relevant Supplier is under any obligation to offer a substitute or any compensation.
26. There is no cash alternative to the Reward. The Reward is non-refundable and non-transferable. The Reward can only be taken by the relevant Awarded Nominee (and their permitted guests, the maximum number of which will be notified to the Awarded Nominee) and must not be sold on.

Data Protection

27. By entering and submitting a nomination you:
    1. agree to be bound by these terms and conditions;
    2. agree that any personal information provided by you in connection with the nomination may be held and used by Keys For, its agents and Suppliers only to administer the recognition initiative.
28. If an Awarded Nominee accepts a Reward they agree and hereby consent to allow Keys For and any Supplier facilitating or providing the Reward (and any companies within their group of companies) to:
    1. process their personal information in accordance with their applicable privacy policy (which will be available on the Keys For and/or Supplier’s website);
    2. and to use their name, details and photographs/videos on any media for advertising and publicity purposes in relation to this initiative and for any other reasonable promotional purpose without additional remuneration.

General

29. Keys For reserve the right to withdraw, change or cancel the recognition initiative at any time. Keys For’s decision in all such matters will be final.
30. Insofar as is permitted by law, Keys For, the Suppliers, and their agents, will not in any circumstances be responsible or liable to compensate the Awarded Nominee or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a Reward except where it is caused by the negligence of Keys For, a Supplier, or their agents, or that of their employees. Your statutory rights are not affected.
31. You agree that Keys For may, but is not required to, make your nomination available on its website www.keysfor.co.uk and any other media, whether now known or invented in the future, and in connection with any publicity of the recognition initiative. You agree to grant Keys For a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the nomination and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the nomination and any accompanying materials for such purposes.
32. This recognition initiative, any dispute or claim arising out of or conjunction with it, and these terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
